Scope of application/Contract Agreement:
- These Terms and Conditions (“T&Cs”) apply to all purchases you make as a consumer through our online store. The seller is Nimora Japan.
- Our products are intended solely for consumers making purchases for personal use. All sales, deliveries, and services made through our online shop are governed exclusively by these T&Cs in the version that applies at the time of your order.
- Any individual agreements made with you will take precedence over these T&Cs. Any differing, conflicting, or additional conditions will not apply unless we have expressly confirmed them in writing.
Contract Conclusion:
- Our product listings serve as a non-binding invitation for you to place an order with Nimora Japan.
- By completing and submitting the online checkout process, you are making a binding offer to purchase the selected goods. Please note that we are under no obligation to accept this offer. An acknowledgment of receipt of your order does not constitute acceptance.
- We may accept your offer within seven (7) calendar days, either by sending you an order confirmation, shipping the goods, or through another clear form of acceptance. If we do not accept your offer within this period, the offer is deemed rejected. In the event that our order confirmation, or any legally binding communication, contains typographical mistakes, printing errors, or pricing inaccuracies caused by transmission issues, we reserve the right to declare the contract void on the basis of error. The responsibility of proving such an error rests with us. Any payments already made by you will be promptly refunded.
Payment terms:
- The payment methods available for your order will be displayed during checkout. We reserve the right to restrict available payment methods for any order and to offer alternatives. The customer is responsible for all transaction fees related to the transfer of funds.
- Credit card payments are authorized and captured at the time of order. Payments made through third-party processors (e.g., PayPal, Apple Pay, Google Pay) are subject to the respective terms and conditions of those providers.
- Payment is deemed complete only upon our receipt of cleared funds. Should a payment be reversed or declined due to your error, you are liable for any resulting costs, including fees for handling the default.
- The customer retains a right of set-off only for claims that are legally finalized or uncontested by Nimora Japan.
- Invoices and credit memos will be issued exclusively in electronic format, to which you hereby consent.
Prices:
- Your order total includes the product price plus any applicable shipping fees. All product prices include the statutory taxes.
- The prices quoted are valid for orders shipped within our service jurisdiction and are only guaranteed at the moment your order is placed.
Legal Jurisdiction:
- Terms of Service, along with any other agreements we have with you, are governed by and interpreted under the laws of Japan.
Right of Withdrawal:
- Customers may withdraw from their purchase contract within 14 calendar days from the date of receiving the products without needing to provide any reason.
- For customers who purchase multiple items in a single order that are delivered separately, the withdrawal period begins from the day the customer receives the last item of their order . This provision prevents the withdrawal period from expiring before customers have received all products they ordered.
- Notify Nimora of their decision to withdraw within the 14-day period. Notification can be made through any clear statement, including via the designated return form on Nimora's website, email, or postal mail.
- Sealed products where the seal has been broken after delivery, particularly those relating to health or hygiene protection (such as intimate wellness products), where returning would be unhygienic or potentially unsafe.
To exercise the right of withdrawal, customers should:
- Complete the withdrawal form available on Nimora's website under "Returns & Exchanges" or send a clear statement indicating their decision to withdraw from the contract. The statement should include:
- Customer name and address
- Order number and date
- Product(s) to be returned
- Clear declaration of withdrawal
- Submit the form via email to returns@nimora.com or via postal mail to Nimora's customer service address. Upon receiving the withdrawal notification, Nimora will promptly send the customer a confirmation receipt via email
Return Process:
After notifying Nimora of their withdrawal:
- Customers will receive return instructions and a return authorization number via email within 3 business days of notification.
- Products must be securely packaged in their original packaging whenever possible to prevent damage during return shipping.
- Customers should include the completed return form and return authorization number inside the package.
- Customers are responsible for arranging return shipment using a tracked delivery service and for paying return shipping costs, unless the return is due to Nimora's error (such as shipping wrong or defective products) .
- After shipping the return, customers should retain the proof of postage and tracking number as evidence of return.
Deduction from funds:
Nimora may make deductions from the refund amount in the following circumstances:
- Diminished value of products resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the products .
- Missing components such as original packaging, accessories, or documentation that were included with the original shipment.
- Return shipping costs will not be refunded unless the return is due to Nimora's error .
All deductions will be clearly explained to customers with photographic evidence when applicable.
Refund Policy:
Upon receiving returned products and verifying they meet return conditions:
- Nimora will process refunds within 14 calendar days from the date of receiving the withdrawal notification or from the date Nimora receives the returned products, whichever is later .
- Refunds will be issued using the same payment method the customer used for the original transaction, unless the customer explicitly agrees otherwise .
- For payments made by credit card, refunds will be credited to the original credit card used for payment. Customers should note that depending on their card issuer's policy, it may take additional time for the refund to appear on their statement.
Return Shipping Costs:
Unless otherwise specified:
- Customers are responsible for the direct cost of returning products .
- Nimora will bear return shipping costs only if the return is due to Nimora's error (e.g., wrong product shipped, defective product, or inaccurate description) .
- For international returns (if applicable), customers are responsible for any customs duties, taxes, or additional fees incurred during the return process.
Product Condition for Returns:
To be eligible for return:
- Products must be in original condition – unworn, unwashed, unused, and with all original tags and packaging intact.
- Hygiene seals must be intact for applicable products. Products with broken hygiene seals cannot be returned for health and safety reasons .
- All original documentation (instructions, warranty cards, etc.) and accessories must be included.
Policy Updates:
Nimora reserves the right to modify this withdrawal policy with appropriate notice to customers:
- Material changes to the policy will be communicated via email to registered customers and announced on the website with at least 30 days' notice .
- Changes will not apply retroactively to purchases made before the policy modification date.
- The policy effective date will be clearly displayed at the top of the policy page
Waranty:
Nimora offers a limited hardware warranty on all products purchased through our official channels:
- Standard Warranty Period: All Nimora products are covered by a 12-month warranty from the date of original purchase
